Importance of constitutional complaints, lack of trifles in Constitutional Court work stressed

MINSK, 20 December (BelTA) – Head of the Belarus President Administration Dmitry Krutoi has emphasized the importance of constitutional complaints and has pointed out that no detail is too small in the Constitutional Court’s work. Dmitry Krutoi made the statements as he introduced new Chairman of the Constitutional Court Sergei Sivets to the Constitutional Court staff and recounted accomplishments of the previous head of the Constitutional Court Piotr Miklashevich, BelTA has learned.

Introducing Sergei Sivets as the new chairman, Dmitry Krutoi noted that he is a determined, very thoughtful person who loves details. “In this regard it is a good quality. Because there can be no trifles in the work of the Constitutional Court, in the decisions and conclusions that you prepare. In accordance with the Constitution, they are final and cannot be appealed or challenged,” said the head of the Belarus President Administration.
Many kind words were spoken about the former chairman, Piotr Miklashevich. According to Dmitry Krutoi, he is a towering figure, a legend for the system within the framework of a modern independent country. “Of course, he has done a great deal in all the positions he has held. But the last stage of his work was within the Constitutional Court,” said Dmitry Krutoi, adding that this man has undoubtedly enhanced the court’s authority.
Speaking about Piotr Miklashevich’s achievements, Dmitry Krutoi noted the introduction of the institution of constitutional complaints, which brought the court closer to the people. “Even the first experience, the first steps in considering such appeals, show that it will be in demand,” he added. “This is a completely different tool and it should be used in a way as to move from a specific, perhaps private case to fundamental nationwide decisions that will affect a large number of our citizens.”

Piotr Miklashevich expressed his gratitude to the head of state for his trust during his 17 years of work in the Constitutional Court. As the head of the commission in charge of drafting amendments and addenda to the Constitution, Piotr Miklashevich has made a worthy contribution to the development of constitutional justice and the improvement of the Basic Law. “I am confident that the renewed composition of the Constitutional Court will effectively fulfill the tasks assigned to it by the Constitution to ensure the supremacy of the Constitution, to develop the constitutional system, and to protect the constitutional rights and freedoms of citizens,” he concluded. 
Addressing Piotr Miklashevich, the new chairman of the Constitutional Court noted that under the leadership of his predecessor the court had stood guard over constitutional legality with dignity and professionalism. “The work on preparing draft amendments and addenda to the Constitution when sparks flew at every meeting of the commission and only you were able to stabilize the situation and find a compromise solution shows how important the role of the Constitutional Court is in the social structure of our state, how much the Basic Law is a guiding thread that ensures unity, consolidation of society, and further steady and harmonious development of our country,” he said.

Sergei Sivets also noted that the Constitutional Court is a special body of judicial control over the inviolability of the social contract and the Basic Law, ensuring the inviolability of the constitutional order, the rights and freedoms of man and citizen guaranteed by the Constitution, as well as ensuring the supremacy and direct effect of the Constitution on the territory of the country. He assured that these important tasks facing the Constitutional Court will be fulfilled.
