
MINSK, 2 May (BelTA) – The Council of the Republic of the National Assembly of the eighth convocation passed the bill on amnesty in connection with the 80th anniversary of Victory in the Great Patriotic War on 2 May, BelTA has learned.
Article 1 of the bill proposes to exempt from punishment and other measures of criminal liability of minors; pregnant women; women and single men with children under 18, except for those who have committed a deliberate crime against life and health, sexual inviolability or sexual freedom of a minor, or a crime involving violence or the threat thereof, or which has caused the death of a person by negligence, or inflicted grievous bodily harm; disabled persons of group I and II.
The bill also proposes to exempt from punishment and other measures of criminal liability of persons with TB who are defined in IA, IIA, III groups for surveillance purposes; persons with oncological diseases of the second, fourth clinical groups; persons with oncohematological diseases who are subject for special medical treatment; HIV-infected persons with stages 3 and 4 according to the clinical classification of the World Health Organization; citizens who suffered from the Chernobyl disaster or other radiation accidents.

The bill also proposes to exempt from punishment and other measures of criminal liability of persons who have suffered wounds (contusions), mutilations, diseases during military service in the Soviet Army and Navy, military formations of the former USSR, the Armed Forces of the Republic of Belarus, other troops and military formations created in accordance with the law, and also persons who have suffered wounds (contusions), mutilations, diseases during service in the Investigative Committee, the State Committee of Forensic Examinations, bodies of internal affairs, financial investigations of the State Control Committee, prosecutor's office, bodies and units of emergency situations.
First-time offenders aged 70 and over who got a jail term of up to six years will be granted clemency. Imprisonment for them will be replaced by the restriction of freedom and they will not be sent to open prisons.
Amnesty will not apply to persons whom were granted amnesty or pardon in 2022-2025 and who have committed a deliberate crime again during the period of unexpunged or unspent convictions; who, as of the day of the verdict (entry of the verdict into legal force, consideration of the materials on application of amnesty) have not fully compensated for the harm (damage) caused by crimes, the costs of medical assistance to victims, have not paid criminal legal compensation, income obtained by criminal means, income derived from the use of property obtained by criminal means or acquired with funds obtained by criminal means.
Amnesty will not apply to persons who maliciously violate the established order while serving their sentence or other measures of criminal responsibility; who have committed especially dangerous repeated offenses or are recognized in accordance with the established procedure as especially dangerous persistent offenders; who have had the death penalty commuted to imprisonment or life imprisonment by way of pardon, or who have had the life imprisonment penalty commuted to imprisonment; who have been sentenced to life imprisonment; who are included in the list of citizens of the Republic of Belarus, foreign citizens or stateless persons involved in extremist activities, or in the list of organizations and individuals, including individual entrepreneurs, involved in terrorist activities; who have not reimbursed arrears of alimony or expenses for the maintenance of children who are (were) on state support, etc.
