Belarus' BelAZ wins court case over trademark

MINSK, 6 November (BelTA) – BelAZ - the managing company of the BelAZ Holding Company has won a court case against the company that illegally used its trademark in a domain name, BelTA learned from BelAZ.

“The seventh Arbitration Court of Appeal upheld the decision passed by the Arbitration Court of Kemerovo Region in July 2020 regarding the case filed by BelAZ that sought to ban the use of the ‘BelAZ' domain name and to get compensation and reimbursement of legal costs,” the company informed.

The lawsuit was filed against Regional Warehouse Transmash (Kemerovo) - the owner of the domain name ‘spareparts-belaz42.rf'. The fact that the company administered the domain name www.spareparts-belaz42.rf was confirmed by the Register of Domain Names REG.RU. When the case was considered, the defendant changed the domain name. According to Andrei Chinkin, Assistant to the Director General for Regime and Economic Security at BelAZ, the company is actively protecting its trademark on the internet. Thus, over the past six months, a number of domains using the company's trademark have been blocked.

Earlier, BELAZ set a precedent in Russia when it received financial compensation for the illegal use of its trademark. The decision was made by the Khakassia Arbitration Court in April 2018. The lawsuit was filed against RosBelService after bringing its director to administrative responsibility for the illegal use of the ‘BELAZ' trademark. The products of this company were declared counterfeit, withdrawn and destroyed.
