Slizhevsky: Procedure of enforcement of EAEU Court decisions needs improving

MINSK, 19 September (BelTA) – The procedure of the enforcement of the EAEU Court decisions needs to be improved, Belarus Justice Minister Oleg Slizhevsky told the press on the sidelines of the international conference “Five Years of the Eurasian Economic Union Treaty: The Role of the Court” that is running in Minsk on 19-20 September, BelTA has learned.

“The parties can take legal action as a means of resolving a dispute as a last resort. Attempts are always made to negotiate a pre-trial settlement. Legal action is really a last resort. I believe that improving the procedure of enforcement of court decisions is to some extent a way to enhance the authority of the court because this procedure is not always clear today. In our view, this procedure must be considered for further clarifications,” Oleg Slizhevsky said.

Improving the procedure of enforcement of the EAEU Court decisions is a key means of implementation of the rule of law, the minister said as he addressed the conference. He thinks that the EAEU Court should set an example in the field of the rule of law in the union. That means that there must be no ambiguities in interpretation and the decisions of the court must fully comply with the existing legal framework.

Deputy Chairman of the Senate of the Parliament of the Republic of Kazakhstan Bektas Beknazarov noted the need to extend the powers of the EAEU Court in dispute resolution. “This must be done at the expense of the Eurasian Economic Commission's powers. Representatives of any member state will defend their country's interests. They argue endlessly and do not arrive at any decision. However, if the court issues a verdict, it is binding on all the parties and the dispute is resolved in no time,” Bektas Beknazarov said.

The conference participants highlighted the importance of the harmonization of national laws.

The event has brought together more than 200 participants: ministers and officials of the Eurasian Economic Commission, government bodies of the member states, constitutional and supreme courts, parliaments, relevant ministries and departments, representatives of international organizations and the judiciary, the business and scientific communities, practicing lawyers.

Various aspects of the legal system of the Eurasian Economic Union will be in focus of the conference. Panel discussions will highlight certain EAEU Treaty provisions, including on the common market, general rules and principles of competition, customs regulation, and the improvement of the institutional system. Application of the laws of the union by the judiciary of its member states will be on the agenda as well.

This year the Eurasian Economic Union, which unites the five member states, celebrates two big dates - the fifth anniversary of the Eurasian Economic Union Treaty and the 25th anniversary of the Eurasian integration initiative.
