Introduction of direct constitutional complaints under consideration in Belarus.

MINSK, 16 June (BelTA) – The possibility of introducing direct constitutional complaints is under consideration in Belarus, BelTA learned from Natalya Karpovich, Deputy Chairwoman of the Constitutional Court, member of the Constitutional Commission, on 16 June.

The official said: “In other words, upon complaints of Belarusian citizens the Constitutional Court will be authorized to check the constitutionality of laws in a specific case if the citizen believes that his or her constitutional rights and freedoms are violated due to the unconstitutionality of specific provisions. Thus, citizens will be granted direct access to constitutional justice. Every interested person will be able to contact the Constitutional Court directly.”

In her words, the constitutional complaint is the most popular form of protection of constitutional rights and freedoms of citizens. All the post-Soviet countries and most of the European countries have instituted constitutional complaints of citizens one way or another.

The sixth session of the Constitutional Commission is in progress today. Constitutional provisions concerning the court system are being discussed.
