Speaker of Belarusian parliament's upper chamber outlines new lawmaking guidelines

MINSK, 2 April (BelTA) – In the course of preparing a bill it is important to thoroughly evaluate additional documents. Chairman of the Council of the Republic of the National Assembly of Belarus Mikhail Myasnikovich made the statement during the opening of the sixth session of the sixth-convocation Council of the Republic of the National Assembly of Belarus, BelTA has learned.

Interaction with the general public on matters concerning the improvement of legislation grows more and more important, Mikhail Myasnikovich is convinced. The law on statutory and regulatory enactments provides multiple options for it such as public discussions, law application monitoring, personal meetings with citizens, conferences, and so on. The format enables direct feedback from people. It allows hearing what they are concerned about in addition to receiving proposals from the grassroots level.

According to Mikhail Myasnikovich, all the bills should be prepared bearing the new guidelines in mind. The amount of work will grow. “It will be necessary to thoroughly analyze not only provisions of the bill but study and compare the bill's additional documents. Their comprehensive review will allow properly forecasting the transformation of public relations, adequately building the substantial part of the law, and fixing drawbacks of its legal constructs,” Mikhail Myasnikovich noted.

It would be advisable for the upper chamber of the Belarusian parliament to discuss with the lower chamber and the central government an approach, as part of which laws can regulate and stipulate principles and norms of the most important relations while mechanisms to implement them are stipulated by bylaws, Mikhail Myasnikovich noted. “It is important that laws contain norms, which have already proven their effectiveness and up-to-date nature through law application at the level of legislation issued by the head of state or the central government. Meanwhile, parliamentarians should enable oversight over the development of enactments in strict compliance with the law. Law application monitoring offers an additional instrument for such oversight,” said the chairman of the Council of the Republic of the National Assembly of Belarus. On the one hand, such practice has a positive effect on the stability of the legal base. On the other hand, the practice adds the necessary dynamics. It allows one to see results of passed legislation, Mikhail Myasnikovich is convinced.

Serious work will have to be done to further improve legislation. Improving the effectiveness of the public sector, which operates in market conditions and faces tough competition at the external contour, was mentioned. Mikhail Myasnikovich reminded that the matter is a key one for the current five-year term.

Work on the bill on insolvency and bankruptcy will be done this year as well as work to amend the law on commercial companies. “I believe the adoption of these laws will allow regulating the most sensitive issues in the work of state-run enterprises and the private sector. In particular, approaches to subsidiary responsibility of owners, to corporate management, financial development of commercial companies, and the resolution of problems of insolvency of companies will be improved,” Mikhail Myasnikovich noted. The information sphere also needs new-generation laws. The bill on personal data provides for a new level of protection of citizens against illegal intrusions into their private life. It will be an important factor in ensuring information sovereignty of the country.

On the whole, according to Mikhail Myasnikovich, it is important to thoroughly weigh the reasons behind every amendment, to model various situations, and assess the consequences the suggested norms can entail in real life.
